Over the past several months, the United States Supreme Court and the California Courts of Appeal have issued several significant regulatory takings opinions addressing the liability of government agencies for enacting regulations or otherwise conditioning proposed developments.  To really dig into these opinions and their importance, Law Seminars International will be putting on a one-hour telebriefing, Regulatory Takings Claims In California, on August 19 at 1 p.m. (PST).  I will be moderating the discussion with two other outstanding regulatory takings attorneys:  Robert Thomas of Damon Key Leong Kupchak Hastert (and author of the blog inversecondemnation.com), and Timothy Kassouni of Kassouni Law (and former attorney at the Pacific Legal Foundation).

We will cover recent developments in takings law and provide a practical overview for property owners and developers on how to navigate through property exactions and regulations that interfere with investment-backed expectations. We will also address how government agencies can protect themselves from possible litigation in what is likely to be a period of increased takings claims.

Mr. Kassouni will focus on the California Court of Appeal's decision in Lockaway Storage v. County of Alameda, which resulted in a significant damages award for a temporary regulatory taking, and could signal an important judicial shift in the state toward the increased use of takings law to reign in government regulations.  He should provide us with some unique insights given his role as lead attorney for the property owner.

Mr. Thomas will focus on land use exactions after the Supreme Court's ruling in Koontz v. St. Johns River Management District, along with the latest in rent control takings challenges.  He is intimately familiar with these issues given he has filed a number of amicus briefs in the various matters.
