The regulations in 49 CFR Part 24 implementing 42 USC Ch. 61, generally known as the “Uniform Act,” are being updated for the first time since 2005. Santa Clara County, the City of Palo Alto, and the local Housing Authority have come together to acquire the Buena Vista mobile home park from its current owner, the Jisser family, in an effort to save the mobile home park from closure. This week marks the nine-year anniversary of the Kelo v. City of New London decision. Since I've been practicing as an eminent domain attorney, Kelo is unquestionably the most well-known and stirring court opinion, creating widespread reform to the use of eminent domain across the country -- even on the opposite coast in California. Last time I checked, about 45 states had passed some sort of eminent domain reform in response to the Kelo decision.

In hopes of modernizing the nation's infrastructure, President Obama revealed a plan to invest $302 billion in transportation over the next four years. On October 5, 2013, Governor Brown signed AB 401 (Daly, D- Anaheim) into law. The new law grants Caltrans, Orange County Transportation Authority, the Santa Clara Valley Transportation Authority and other regional transportation agencies expanded authority to use design build for project procurement. Caltrans just announced that California will be receiving $155 million in extra funding for launching its new construction projects before federal deadlines. Caltrans will receive about $97 million of that award, with local and regional agencies receiving the balance. States that fail to meet federal deadlines lose funds, which revert to a pool that benefits states like California, that consistently launch projects on time. This year, California received the largest share of that pool, with New York the next highest at $81 million.
